Terms of Service

These terms of service should be reviewed by legal counsel before being relied upon as a binding legal document.
1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the services provided by Saffron AI, Inc. (“Saffron,” “we,” “us,” or “our”), including our website at trysaffron.ai and our technical assessment platform (collectively, the “Service”).
By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Service
Saffron provides an AI-native technical assessment platform that enables companies (“Customers”) to evaluate engineering candidates. The platform allows candidates to complete real-world coding tasks in isolated cloud environments, with full session recording, AI interaction tracking, and automated scoring powered by multi-agent AI analysis.
3. User Accounts
To access certain features of the Service, you must create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us promptly of any unauthorized access to your account
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.
4. Customer Responsibilities
If you are a Customer using the Service to assess candidates, you agree to:
- Inform candidates that their assessment session will be recorded and analyzed, including all code, AI interactions, and development activity
- Obtain any consents required under applicable law before administering assessments
- Use assessment results and candidate data in compliance with applicable employment, privacy, and anti-discrimination laws
- Not use the Service to discriminate against candidates on the basis of any protected characteristic
5. Candidate Assessment Terms
By participating in an assessment on the Saffron platform, candidates acknowledge and agree that:
- The entire assessment session will be recorded, including all code written, files accessed, terminal commands executed, and AI tool interactions
- Saffron's AI systems will analyze the session to generate automated scores, including attribution of human-written versus AI-generated code
- Assessment results, session recordings, and analysis will be shared with the Customer who administered the assessment
- The assessment environment is isolated and temporary — all sandbox environments are destroyed after the session concludes
- Candidates should not include personal credentials, proprietary code, or sensitive information beyond what is required for the assessment
6. Intellectual Property
Customer Content
Customers retain all ownership rights in their codebases, assessment configurations, and any proprietary materials uploaded to the platform. Saffron does not claim ownership of Customer content. We use Customer content solely to provide and improve the Service.
Candidate Work Product
Code and other work product created by candidates during assessments are owned according to the agreement between the Customer and the candidate. Saffron does not claim ownership of candidate work product.
Saffron Platform
The Saffron platform, including its scoring algorithms, AI analysis systems, user interface, documentation, and all related intellectual property, is and remains the property of Saffron. These Terms do not grant you any right to use Saffron's trademarks, logos, or other brand features without our prior written consent.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Attempt to gain unauthorized access to any part of the Service or its related systems
- Reverse engineer, decompile, or disassemble any aspect of the Service
- Interfere with or disrupt the integrity or performance of the Service
- Use the Service to develop a competing product or service
- Share assessment content, questions, or configurations with unauthorized parties
8. Payment Terms
Access to the Saffron platform is provided under a subscription or per-assessment pricing model as agreed upon during onboarding. Payment terms, including pricing, billing frequency, and payment methods, are specified in your service agreement.
Fees are non-refundable except as required by law or as explicitly stated in your service agreement.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Saffron shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.
Saffron's aggregate liability for any claims arising out of or relating to the Service shall not exceed the amount you paid to Saffron in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify and hold Saffron harmless from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
11. Termination
Either party may terminate the service relationship at any time in accordance with the applicable service agreement. Upon termination:
- Your access to the Service will cease
- We will retain your data for a reasonable wind-down period to allow for data export, after which it will be deleted
- Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will continue in effect
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware.
13. Changes to These Terms
We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the “Last updated” date. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
